A settlement has been provisionally approved by the court in a case involving Zoom Video Communications, Inc. (“Zoom”), regarding allegations made by a number of individual Zoom users who sued on their behalf and those with claims similar regarding the privacy and security of the Zoom Meetings Application (“Application”). By entering into the regulations, Zoom did not acknowledge its responsibility; instead, the two sides agreed to resolve the dispute in order to avoid further risks and expenses related to the disputes. The court did not decide who was right.
Who is included in the settlement? People in United States who has registered, used, opened or downloaded the Zoom Meetings app, other than through an enterprise-level account or a Zoom government account, between March 30, 2016 and July 30, 2021. The Settlement Group also excludes Zoom and its officers and directors, as well as the judge or magistrate to whom the action is attributed, and any staff of such judges or members of the immediate family.
What relief does the settlement offer? a $ 85 million The Settlement Fund will be set up to pay valid claims after deducting court-approved attorneys’ fees (up to $ 21,250,000) and expenses (up to $ 200,000), applicants’ service payments, and notification and administration fees. Zoom has made and continues to make changes to its policies and practices for the benefit of Settlement Class Members. Settlement Class Members may submit one of the following types of claims:
- Paid subscription request: If you have paid a subscription to the Zoom Meetings app, enter March 30, 2016 and July 30, 2021, you can file a complaint for 25 $ or 15% of the money you paid Zoom for the primary subscription, whichever is greater (this does not not include optional features / supports that can be added to subscriptions). For example, if you have spent $ 75 on a subscription during the period considered, 15% of $ 75 is $ 11.25. Since $ 11.25 is inferior to 25 $, your complaint will be for 25 $.
- User complaint: If you are not eligible for a paid subscription request and have signed up, used, opened or downloaded the Zoom Meetings app between March 30, 2016 and July 30, 2021, you can file a complaint for $ 15 (you are beautiful not eligible to submit a paid subscription request).
These payment amounts may be reduced depending on the number of valid claims. Nothing will happen unless the Court approves the Settlement.
How to get payment? You must submit your claim online at www.ZoomMeetingsClassAction.com or mail a postmarked paper claim form March 5, 2022. Paper claim forms are available on the website or by calling 1-800-397-3418.
Are there other options? If you are a Settlement Class member, you have several options other than filing a claim. If you do not want to be legally bound by the Settlement, you must opt out by March 5, 2022. If you do not exclude yourself, you will release your claims against Zoom regarding all allegations in the matter. You can object to the Settlement by March 5, 2022. The Detailed Notice available on the website explains how to exclude or object. The Court will hold a final approval hearing on April 7, 2022 To 1:30 p.m. consider whether to approve the Settlement and award service payments, attorneys’ fees and expense charges; and consider all objections. You or your lawyer can attend and request to appear at the hearing, but you are not required to do so.
